This website is operated by Venustare, LLC ("Venustare," "we," "us," or "our"), a limited liability company organized under the laws of the State of Wyoming. These Terms apply to all users of the site, including browsers, customers, and merchants. By visiting our site and/or purchasing a product, you agree to be bound by the following Terms of Service, including any additional terms and policies referenced or linked here, including our Shipping & Returns page and our Privacy Policy.

Please read these Terms carefully before using the site. If you do not agree to all of them, you may not access the site or use any of its services.

1. Online Store Terms

By using our site, you represent that you are of legal age in your state or province of residence, or that you have a parent or guardian's consent. You must not use our products for any unlawful purpose, nor may you violate any laws in your jurisdiction, including copyright law.

2. General Conditions

We reserve the right to refuse service to anyone, for any reason, at any time. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the site or its content without our express written permission. Unauthorized commercial use of any content, imagery, or product presentation on this site may result in legal action.

3. Accuracy, Completeness & Timeliness of Information

We strive for accuracy but can't guarantee the site's information is complete or current. Relying on it for decision-making is at your own risk. We may modify the site's contents at any time without notice.

4. Modifications to the Service and Prices

Prices are subject to change without notice. We may modify or discontinue the service, or any part of it, at any time, and we won't be liable to you or any third party for doing so.

5. Products and Sourcing

Venustare is an independent reseller. The pieces offered here are handcrafted by D'Argenta or another independent atelier we curate, not manufactured by Venustare. Each piece is handcrafted and produced in limited quantity; slight natural variations in finish, texture, and tone are inherent to the finishing process and are not defects. We've made every effort to display colors and finishes accurately, but we can't guarantee your device renders them exactly true. Products are subject to our Return Policy.

6. Fulfillment and Stock Availability

Some or all pieces are produced and/or shipped by an independent atelier rather than held in Venustare's own inventory. Production and shipping timelines given at checkout or in communications are estimates, not guarantees, and may be affected by production capacity, carrier delays, or events outside our control. Stock availability isn't guaranteed at the time of order; if a piece becomes unavailable or can't be produced in a reasonable time, we may cancel that portion of the order and refund the amount paid for it. That refund is your sole remedy for such a cancellation. Orders may ship directly from a manufacturing or fulfillment facility. Risk of loss and title pass to you upon our delivery to the carrier.

7. Billing and Account Information

We reserve the right to refuse or cancel any order, including where pricing or availability errors have occurred. You agree to provide current, complete, and accurate purchase and account information, and to keep it updated so we can complete transactions and reach you as needed.

8. Optional Tools & Third-Party Links

We may give you access to third-party tools we don't monitor or control, provided "as is" and "as available." Content and links on this site may direct you to third-party sites; we aren't responsible for their content, accuracy, products, or services.

9. User Comments & Submissions

If you send us feedback, ideas, or other materials, you agree we may edit, copy, publish, distribute, and otherwise use them in any medium without restriction, without any obligation to keep them confidential, compensate you, or respond.

10. Personal Information

Your submission of personal information through the site is governed by our Privacy Policy, which is incorporated here by reference.

11. Errors, Inaccuracies & Omissions

The site may occasionally contain typographical errors or inaccuracies relating to product descriptions, pricing, promotions, or availability. We reserve the right to correct these and to change, update, or cancel orders affected by them, at any time and without prior notice.

You may not use the site for any unlawful purpose; to solicit unlawful acts; to violate regulations or laws; to infringe our or others' intellectual property; to harass, defame, or discriminate; to submit false or misleading information; to transmit viruses or malicious code; to collect others' personal information; or to spam, phish, or scrape the site.

13. Disclaimer of Warranties; Limitation of Liability

We don't guarantee the site will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, Venustare and its members, officers, employees, affiliates, agents, contractors, and manufacturing partners won't be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the site or its products, however caused. In all cases, our total liability to you for any claim won't exceed the amount you paid for the specific product giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Venustare and its members, officers, affiliates, agents, and employees from any claim arising from your breach of these Terms, your violation of any law, or your violation of a third party's rights.

15. Force Majeure & Severability

Venustare isn't liable for delay or failure to perform caused by events beyond our reasonable control: natural disaster, pandemic, labor dispute, customs delay, carrier disruption, or supplier/atelier delay, among others. If any provision of these Terms is found unenforceable, it will be enforced to the fullest extent permitted, and the rest remains in effect.

16. Termination

These Terms remain in effect until terminated. You may stop using the site at any time; we may terminate your access if, in our judgment, you've violated these Terms or exposed us to legal liability. Provisions that by their nature should survive termination (intellectual property, indemnification, disclaimers, and limitations of liability) do.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms will be resolved exclusively through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Cheyenne, Wyoming, in English, with remote hearings available on request. The award is final and binding. Each party bears its own legal costs unless the arbitrator decides otherwise. By agreeing to these Terms, you waive any right to bring claims in court, before a jury, or as part of a class action.

18. Changes to These Terms

We may update these Terms by posting changes to this page; it's your responsibility to check back periodically. Continued use of the site after a change means you accept it.

Intellectual Property

All content on this site (text, graphics, logos, product photography, layout, and design) is the property of Venustare, LLC or its licensors and is protected under applicable IP law. Unauthorized reproduction, distribution, or commercial use of any content is strictly prohibited. Product designs and craftsmanship depicted here originate with our independent ateliers and are used under arrangement with them; nothing on this site licenses any visitor to reproduce, resell, or otherwise commercially exploit any product design, image, or content without our express written permission.
